For the Bukinex cloud tool (free service under Belgian/EU law)

By creating an account or using the Service, you agree to these Terms of Use and this Privacy Policy.
Part A - Terms of Use
1) Free service / scope
The Service is provided free of charge. These Terms govern your access to and use of the Service, including any features, content, or functionality made available by Bukinex.
2) "As-is" / no warranties
The Service is provided "as is" and "as available." To the maximum extent permitted by applicable Belgian/EU law, Bukinex disclaims all warranties and representations, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and any warranties that the Service will be uninterrupted, secure, error-free, or available at all times.
You acknowledge that outputs, calculations, suggestions, and results generated by the Service may contain errors or be incomplete and must be independently verified before you act on them.
3) No professional advice
The Service is provided for informational and productivity purposes only and does not constitute professional advice, including legal, financial, engineering, or compliance advice. You are solely responsible for decisions and actions taken based on the Service.
4) Limitation of liability (free service)
To the maximum extent permitted by applicable law, Bukinex will not be liable for any loss or damage arising out of or in connection with your use of, or inability to use, the Service, including but not limited to loss of data, loss of profits, loss of revenue, business interruption, loss of goodwill, loss of opportunity, and any indirect, incidental, special, consequential, or punitive damages.
Whether in contract, tort, including negligence, strict liability, or any other legal theory, this applies even if Bukinex has been advised of the possibility of such damages.
Liability cap: Because the Service is provided free of charge, Bukinex's total aggregate liability for any claims relating to the Service is limited to EUR 0, to the extent permitted by applicable law.
5) Mandatory legal carve-out
Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted under applicable Belgian/EU law. In particular, nothing excludes or limits liability for fraud, intentional misconduct, or any other liability that cannot legally be excluded.
6) Your responsibilities
- Provide accurate account information and keep your login credentials confidential.
- Use the Service only for lawful purposes.
- Ensure you have the rights to upload or store any content you provide.
- Keep backups of any data you consider important.
7) Prohibited use
- Do not attempt to gain unauthorized access to the Service, other accounts, or underlying systems.
- Do not disrupt, overload, probe, scan, or test the vulnerability of the Service except where explicitly permitted.
- Do not reverse engineer or bypass security measures except where mandatory law grants such rights.
- Do not upload malware or use the Service to conduct abusive, illegal, or infringing activities.
8) User content
You retain ownership of content you submit to the Service ("User Content"). You grant Bukinex a limited, non-exclusive license to host, process, and display User Content solely to provide and operate the Service.
9) Service availability, changes, and discontinuation
Bukinex may modify, suspend, or discontinue the Service, in whole or in part, at any time. We will try to provide reasonable notice where practical, but this is not guaranteed.
10) Termination
You may stop using the Service at any time. Bukinex may suspend or terminate your access if you violate these Terms or if needed to protect the Service or other users.
11) Governing law and jurisdiction (Belgium/EU)
These Terms are governed by the laws of Belgium. For business users, disputes shall be submitted to the competent courts of the competent Belgian arrondissement. If you are a consumer, you may benefit from mandatory consumer protection rules and may bring claims in the courts competent under applicable law.
12) Changes to these Terms
We may update these Terms from time to time. The "Last updated" date will change. Continued use after changes means you accept the updated Terms, to the extent permitted by law.
Part B - Privacy Policy (GDPR)
This section explains how Bukinex processes personal data when you register for and use the Service, in accordance with the General Data Protection Regulation (GDPR) and applicable Belgian law.
1) Roles and contact details

Hosting: Self-hosted on Bukinex-managed infrastructure in Belgium
Analytics: None. No third-party analytics or behavioral tracking.
2) Personal data we process
We process the following categories of personal data as needed to operate the Service:
A. Account data
- Email address (required)
- Username/display name (optional)
- Password (stored only as a secure hash)
B. Security & technical log data
- IP address
- Basic device/browser data (user agent)
- Login events, error logs, and security logs
C. User content
- Data you enter or upload into the Service, for example settings, configurations, and stored content
We do not intentionally collect special category data such as health data or political opinions. Please avoid uploading such data.
3) Purposes of processing
- Create and manage your account and authenticate access.
- Provide core Service functionality and store your settings and content.
- Secure the Service and prevent abuse or fraud.
- Troubleshoot errors and maintain service reliability.
- Communicate with you about account, security, and service-related matters.
4) Legal bases (GDPR Article 6)
- Contract (Art. 6(1)(b)) - to provide the Service you request.
- Legitimate interests (Art. 6(1)(f)) - security, abuse prevention, and maintaining reliability.
- Legal obligation (Art. 6(1)(c)) - where we must comply with legal requirements.
5) Data retention
- Account and User Content: retained while your account is active.
- After account deletion: deleted or anonymized within 30 days, unless retention is required for legal reasons or dispute handling.
- Security/server logs: retained for 30 to 90 days, longer only if needed for investigating security incidents.
- Backups: encrypted backups may persist for a limited rolling period before being overwritten.
6) Sharing and transfers
Because we host on our own infrastructure and do not use analytics, we generally do not share your personal data with third parties.
We may disclose data only if required by law or valid legal process, or to protect the rights and safety of Bukinex, users, or the public, for example when responding to abuse or security incidents.
International transfers: We do not transfer personal data outside the EEA as part of normal operations, unless you explicitly enable a feature or integration that requires it.
7) Security measures
- TLS encryption in transit
- Access controls and least-privilege administration
- Password hashing
- Logging and monitoring for suspicious activity
No method of transmission or storage is 100% secure. Please use a strong unique password and keep credentials confidential.
8) Your GDPR rights
You have the right to access your personal data, rectify inaccurate data, request erasure where applicable, restrict processing or object to processing, data portability where applicable, and withdraw consent where processing is based on consent.

9) Complaints (Belgium)
You may lodge a complaint with the Belgian supervisory authority: Gegevensbeschermingsautoriteit / Autorite de protection des donnees (APD/GBA).
10) Cookies
We use essential cookies only to maintain your session, keep you logged in, and protect security, for example with CSRF protection. We do not use analytics or advertising cookies.
11) Children
The Service is not intended for children under 16. We do not knowingly process personal data from children.
12) Changes to this Privacy Policy
We may update this Privacy Policy from time to time. The "Last updated" date will reflect changes. If changes are material, we will provide additional notice where appropriate.
